1. Acceptance of the Terms
By accessing or using privatepdfjoiner.com (“Service”, “Website”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not accept the Terms, do not use the Service.
2. Service Description
The Service is a free tool that merges the PDF files you upload. No registration or software installation is required.
3. Eligibility & User Responsibilities
- You must be at least 16 years old (or the age of digital consent in your EU Member State) to use the Service.
- You warrant that you have all necessary rights to upload, merge, and download any file you submit.
- You are solely responsible for:
- storing the file securely;
- ensuring that your use of the Service complies with all applicable laws.
4. Intellectual Property
- All Website software, design, text, graphics, and other content are owned by us or our licensors and are protected by intellectual‑property laws.
- Using the Service does not transfer any ownership rights to you.
- You grant us a limited, non‑exclusive, revocable licence to process your uploaded file solely to provide the Service.
5. Prohibited Use
You must not:
- upload or process files containing unlawful, infringing, or malicious content;
- upload personal data you are not authorised to process;
- interfere with or disrupt the Service or servers;
- use automated means (bots, scripts) to abuse or overload the Service;
- reverse‑engineer, decompile, or disassemble any part of the Website.
6. File Handling & Retention
- Files are transmitted to our servers via HTTPS, encrypted locally, and automatically deleted from temporary storage no later than one hour after the protected file is made available for download.
- We do not keep a copy of the files.
- Because deletion is permanent, we cannot restore lost or corrupted files.
7. Data Protection & Privacy
We process only the minimal personal data required to provide the Service (e.g., IP address, device metadata). Processing is based on Article 6(1)(b) GDPR (performance of a contract). For full details, see our separate Privacy Policy.
8. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non‑infringement, or that the encryption will be unbreakable or the Service uninterrupted.
9. Limitation of Liability
To the maximum extent permitted by law:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising out of your use of (or inability to use) the Service.
- Our aggregate liability under these Terms shall not exceed €50 (fifty euro).
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded.
10. Indemnification
You agree to indemnify and hold us harmless from any claim, demand, or damage (including reasonable legal fees) arising out of your breach of these Terms or misuse of the Service.
11. Modifications, Suspension, and Termination
- We may modify the Service or these Terms at any time. Material changes will be announced on the Website at least 14 days before they take effect. Continued use after that date constitutes acceptance.
- We reserve the right to suspend or terminate the Service (or your access to it) at our discretion and without liability.
12. Governing Law & Jurisdiction
These Terms are governed by the laws of Finland. Any dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of Helsinki, unless mandatory consumer‑protection rules provide otherwise.
13. EU Consumer Rights & ODR
If you are an EU consumer, you have statutory rights that are not affected by these Terms. You may also use the EU Commission’s Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr/.
14. Severability
If any provision of these Terms is held invalid, the remaining provisions remain in full force.
